Terms of service
Updated: October 30, 2026. These are the terms for using Malaffaty: what it is, who can use it, your account, early access, your family's files, the AI, and the part for people who were invited.
1. Who we are, and what you are agreeing to
Malaffaty is run by Applied AI Inc, a Delaware corporation, under its ExAutomatica brand. Questions about these terms: hello@malaffaty.com, or write to us in the same WhatsApp chat.
By creating an account or using Malaffaty you agree to these terms and to our privacy policy. If you do not agree, please do not use Malaffaty. Sections 1 to 11 are for people who open an account; section 12 is for people who were invited to someone's file.
2. What Malaffaty is
One health file per real person, looked after by the people in their family. You send a photo of a lab result, a prescription, a scan or a vaccine card to our WhatsApp number; Malaffaty reads it, confirms what matters with you inside the chat, and keeps it in the right person's file. The same chat answers questions from the documents and gives plain, careful guidance: what a value means, what to ask the doctor, when to go now. On the website you sign in with your number, see your family, set who may see whom, and read each person's file.
Malaffaty is not a doctor, a clinic or a medical device. It does not diagnose or treat. In an emergency, call your doctor or go to the nearest emergency room.
3. Who can use Malaffaty
To open an account you must be 18 or older, able to enter into a binding agreement, sign up with your own WhatsApp number (one account per number), and not have been barred from Malaffaty before. A file for a child, or for an adult without WhatsApp, is opened and looked after by an adult who is responsible for that person.
4. Your account
You sign up by sending the start code from our website to our WhatsApp number, or by accepting an invitation sent to your number. You sign in on the website with a code we send to your WhatsApp. An email address is optional; if you give one, we use it only to confirm a new device.
Keep your phone and your account to yourself. You are responsible for what happens under your account; if you think someone else has used it, tell us at hello@malaffaty.com.
5. Early access, free
Malaffaty is in early access. It is free while it is in early access. There is no payment step and we hold no card details. We may change Malaffaty, pause it or stop it while it is in early access, and we may introduce a paid plan later; if we do, we will tell you before anything is charged.
Early access is not finished software: parts may change, break or be withdrawn without notice, and we make no promise about availability.
6. Your family's files, and who sees what
Every real person has one file, however many relatives look after it. You always see your own file. Seeing someone else's file is a grant from that person, or from whoever looks after them when they have no account. Grants are one-way and never pass through a third person: two sisters who both look after their mother see nothing of each other unless they grant it. There are two levels: looking after a file (adding documents, confirming, inviting others, removing access) and seeing it (reading, asking).
You choose whom to invite, and you send each invitation yourself, from your own WhatsApp. Our number messages a person only after that person has written to it or accepted an invitation. An adult with WhatsApp whose file was opened by a relative receives one message asking whether they agree, and can say no.
Only add people and documents you are entitled to add. A person can ask us at any time to remove their file or to take it over.
7. The AI
The assistant that reads documents and answers in the chat is AI, and says so whenever anyone asks. Behind it are language models run by outside companies (named in the privacy policy). It can make mistakes: a value can be misread, a question can be misunderstood. That is why every document is confirmed with you before it is saved, and why the guidance stays plain and always tells you when to see a doctor. Check anything that matters against the original document and with a professional.
8. What you agree not to do
You agree not to use Malaffaty for anything illegal; not to add a person, or a document about a person, that you have no right to add; not to use it to monitor someone against their wishes; not to share your account, or try to reach our systems or other people's files; and not to upload anything malicious or interfere with how Malaffaty runs.
9. Messages we send you
Inside a conversation we reply freely. Outside it we send only short service messages on WhatsApp: a document waiting for your check, a reminder you set yourself, a request from a relative for access, a consent question, and a receipt of what was saved. We do not use your number or your email for marketing, and we do not sell your information.
10. How long we keep things, and deleting your account
What we keep and for how long is in the privacy policy. You can delete a single file, or your whole account, from the settings page at any time. Deletion runs within a day; backups follow within 7 days. Files you looked after together with others stay with the others; files only you looked after are deleted with your account.
We may suspend or end your access if you break these terms or misuse Malaffaty.
11. Liability, changes, the rest
Malaffaty is provided as it is, during early access, without warranties of any kind. To the extent the law allows, Applied AI Inc is not liable for indirect or consequential loss arising from your use of Malaffaty, and its total liability to you is limited to the amount you paid us in the twelve months before the claim, which during early access is nothing. Nothing in these terms limits liability that cannot be limited by law.
We may update these terms; the date at the top changes when we do, and for a material change we tell you in the chat first. These terms are governed by the laws of the State of Delaware, United States. If any part of these terms is found unenforceable, the rest remains in effect. These terms and our privacy policy are the entire agreement between you and us about Malaffaty.
12. If you were invited
Someone in your family added you to a file, or opened a file for you. You decide: you can accept, ignore, or say no, and you can withdraw later from the settings page or by writing to us. Accepting an invitation to see or look after a file does not give anyone access to yours. Everything in these terms about your own account applies to you once you open one.
Counsel review pending. Written in plain language on purpose; where it conflicts with a reviewed version later, the reviewed version applies.
